【摘要】： 暴力犯罪以其犯罪行為的突發性,犯罪手段的殘忍性和犯罪后果的嚴重傷害性對社會秩序和民眾的安全構成重大威脅。因此,分析暴力犯罪行為發生的背景,揭示暴力犯罪行為決策的過程和機制,為更好地預防暴力犯罪行為的發生具有一定的理論意義和實踐價值。 本文運用訪談法對哈爾濱市某監獄中因暴力犯罪入獄的現服刑人員進行了實證研究。研究顯示,暴力犯罪者的行為大多具有沖動、好斗、意氣用事等非理性特征,這與其成長的家庭環境和所處的地域亞文化的影響密不可分。進一步分析顯示,暴力犯罪者有欠缺的家庭環境使得其受教育程度普遍偏低下,導致其缺乏發展潛力和專業技能。這意味著其通過合法途徑獲得成功的可能性降低,這也為犯罪行為的發生提供了潛在的動因。調查顯示,表現在時間和空間上的情境因素對犯罪行為的發生具有催發作用。在這種情境下,暴力犯罪者對案發事件往往進行極端化的認知,并對擬采取的暴力行為進行合理化的建構,在對成本與收益的評估后進行犯罪行為決策。 暴力犯罪者行為決策的發生過程表明,表面上看似屬于一時沖動的暴力犯罪行為,其發生與犯罪者成長的社會家庭文化背景以及犯罪者對事件的理解密切相關。這從另一個側面為暴力犯罪的預防提供了理論依據,通過“親家庭運動”、重塑社會亞文化、大力發展幫扶體系等措施,為青少年的成長提供良好的發展環境,預防不良習氣,培養理性精神,從而預防犯罪行為的發生。
[Abstract]:Violent crimes pose a major threat to the social order and the safety of the population because of the sudden nature of their criminal acts, the cruelty of the means of committing crimes and the serious harm caused by the consequences of the crime. Therefore, the context in which violent crime occurs is analysed, It is of theoretical significance and practical value to reveal the decision-making process and mechanism of violent criminal behavior in order to better prevent the occurrence of violent criminal behavior. This paper makes an empirical study on the current inmates of a certain prison in Harbin for violent crimes. The research shows that the behavior of violent offenders is mostly irrational, such as impulsiveness, aggression, willpower and so on. This is inextricably linked to the family environment in which they grew up and the impact of their geographical subcultures. Further analysis shows that the lack of a family environment for perpetrators of violence generally leads to a low level of education, This leads to a lack of development potential and professional skills... which means that they are less likely to succeed through legal means, which also provides a potential incentive for the commission of criminal acts. The contextual factors, which are manifested in time and space, have a catalytic effect on the occurrence of criminal behavior. In this situation, the violent offenders tend to carry on the extreme cognition to the crime incident, and carry on the rationalization construction to the violence behavior to be taken. Make criminal decision after evaluating the cost and income. The process of making decisions about the behavior of violent offenders shows that what appears to be an act of violent crime on the face of it is an act of violence on impulse. Its occurrence is closely related to the social and cultural background of the offender's growing up and the offender's understanding of the incident. It provides a theoretical basis for the prevention of violent crime from another aspect, and reinvents the social subculture through the "pro-family movement". To develop the help system and other measures to provide a good development environment for the growth of young people, prevent bad habits, cultivate rational spirit, so as to prevent the occurrence of criminal behavior.
