聘任制下高校教師合法權利的法律保障與救濟

【摘要】:作為我國高校人事制度改革的核心內容,高校教師的聘任制同時也是現代大學各項制度改革與建設不可或缺的重要組成部分。以聘任制為核心的我國高等院校教師人事制度改革從2000年提出以后便進入緊鑼密鼓地實施階段,并初具規模地構建起具有中國特色的高校教師聘任制度框架。有改革必然有阻礙。在聘任制實施進程中,伴隨著高校與教師之間多元化關系的形成,利益糾紛和權利保障的研究也出現諸多新的類型、特點以及困境。在聘任制的具體實施過程當中常會出現侵犯教師合法權益的現象,然而目前能解決這些現象的法律與政策卻相當匱乏,與聘任制相適用的法律法規不健全,我國要提高高校教學質量或發展教育事業困難重重。另外,從法律關系上來講高校與教師之間的關系實際上是具有行政與民事的雙重法律關系的。這就亟需我們開創全新的發展視野,從制度與法律、理論與實踐雙向層面,對高校教師聘任制進行完善;構建行政與司法并行的糾紛解決體系,健全并完善與聘任制相配套的法律法規,從而最大限度地保障教師的合法權益,有效解決糾紛。
[Abstract]:As the core content of the personnel system reform in colleges and universities in our country, the appointment system of university teachers is also an indispensable part of the reform and construction of various systems in modern universities. Since 2000, the reform of teacher personnel system in colleges and universities in China, with appointment system as the core, has entered the stage of intensive implementation, and has begun to construct a framework of teacher appointment system with Chinese characteristics on a large scale. There must be obstacles to reform. In the process of the implementation of the appointment system, with the formation of the pluralistic relationship between colleges and universities and teachers, many new types, characteristics and dilemmas have emerged in the study of interest disputes and rights protection. In the course of the specific implementation of the appointment system, there will often be phenomena that infringe on the legitimate rights and interests of teachers. However, at present, the laws and policies that can solve these phenomena are quite scarce, and the laws and regulations applicable to the appointment system are not perfect. It is difficult for our country to improve the teaching quality of colleges and universities or develop the cause of education. In addition, from the point of view of legal relationship, the relationship between colleges and teachers is actually a dual legal relationship between administration and civil affairs. Therefore, it is urgent for us to create a new vision of development and perfect the appointment system of teachers in colleges and universities from the two-way level of system and law, theory and practice. To construct the parallel dispute resolution system of administration and judicature, perfect and perfect the laws and regulations matching with the appointment system, so as to protect the legitimate rights and interests of teachers to the maximum extent and solve the disputes effectively.
