【摘要】：放生活動作為一種宗教習俗在我國有著悠久的歷史和一定的群眾基礎。由于缺乏專業指導和監管,放生引起了環境污染、生態入侵等危害自然生態系統和生態安全的事件,造成大量放生動物無效死亡、危害公共安全、助長非法獵捕等,影響放生地居民正常的生產生活,給野生動物保護與管理帶來隱患,同時也違背了放生"尊重生命"的本意。2016年新修訂的《中華人民共和國野生動物保護法》將動物放生納入管理范圍,使對動物放生的監管有了明確的法律依據和支持,切合我國自然保護的現實需求。為實現對放生活動的科學監管,本文建議繼續完善法規來加強放生管理,明確監管部門,制定放生管理的技術標準和管理制度,提出包括放生環境選址、放生動物規模、放生動物適合度、放生時間地點和放生監測方案等指標的放生技術標準,以期為放生提供制度和技術保障,使動物放生得以科學、有序、安全開展。同時,放生本質上仍然是人類對自然生態系統的干擾,科學放生的終極目標應為取消放生,建議通過更新觀念、開展動物及棲息地保護來實現關愛動物的放生目的。
[Abstract]:As a religious custom in China, the activities of releasing life have a long history and a certain mass base. Due to the lack of professional guidance and supervision, the release of life has caused environmental pollution, ecological invasion and other incidents that endanger the natural ecosystem and ecological security. Causing invalid deaths of a large number of released animals, endangering public safety, encouraging illegal hunting and catching, affecting the normal production and life of the residents of the released areas, and bringing hidden dangers to the protection and management of wild animals. At the same time, it also runs counter to the original intention of "respecting life." the 2016 revised Wildlife Protection Law of the people's Republic of China has brought animal release into the scope of management, which has provided a clear legal basis and support for the regulation of animal release. In order to realize the scientific supervision of the release activities, this paper suggests that we should continue to improve the laws and regulations to strengthen the management of release, make clear the supervision department, and formulate the technical standard and management system of the release management. In order to provide the system and technical guarantee for the release of animals, the technical standard of release including the location of the environment, the scale of the released animal, the suitability of the released animal, the time and place of the release and the monitoring scheme of the release of the animal were put forward, in order to provide the system and technical guarantee for the release of the animal, so that the animal can be released scientifically. At the same time, the nature of release is still human interference to the natural ecosystem. The ultimate goal of scientific release should be to cancel the release. Develop animal and habitat protection to achieve the purpose of animal release.
